Last Updated: 15 May 2025 · Effective: 15 May 2025
1. About These Terms
These Terms and Conditions govern your use of the website at https://damaim.blog (the "Website") and the legal services offered by Damai ("we", "us", "our"), a family law practice based at Suite 3-9, Menara Landmark, Jalan Tun Razak, 50400 Kuala Lumpur, Malaysia.
By accessing the Website or engaging our services, you agree to these terms. If you do not agree, please refrain from using the Website or engaging our services.
2. Nature of Website Content
The content published on this Website is for general informational purposes only. It does not constitute legal advice and does not form a solicitor-client relationship. Legal matters are fact-specific; nothing on this Website should be relied upon as a substitute for advice tailored to your individual circumstances.
We take reasonable care to ensure the accuracy of content on this Website, but we make no representations or warranties regarding its completeness, currency, or fitness for any particular purpose. Laws and procedures may change; please confirm the position with us before acting on any information found here.
3. Engagement of Legal Services
A solicitor-client relationship with Damai is established only upon the signing of a formal letter of engagement and, where required, the execution of a fee agreement. Submitting an enquiry via the Website's contact form or sending an email does not create a solicitor-client relationship.
We reserve the right to decline any engagement at our discretion, including where a conflict of interest exists, where the matter falls outside our practice areas, or where we are unable to offer the level of service the matter requires.
4. Fees and Billing
Fees for our services are outlined in the relevant service descriptions and confirmed in your engagement letter. Published prices on the Website are indicative starting figures and may vary depending on the complexity of your matter and the work actually required.
Invoices are issued in accordance with the terms set out in your engagement letter. Fees are payable within the period stated on each invoice. We charge in Malaysian Ringgit (RM). Queries about any invoice should be raised with us within 14 days of the invoice date.
We are members of the Malaysian Bar and our fee arrangements are subject to the Legal Profession Act 1976 and the Solicitors' Remuneration Order as applicable.
5. Confidentiality
We maintain strict confidentiality over all client information and communications, consistent with our professional obligations under the Legal Profession Act 1976 and the rules of the Malaysian Bar. Legal professional privilege applies to confidential communications made for the purpose of giving or receiving legal advice.
Confidentiality does not extend to information we are required to disclose by law, court order, or regulatory obligation.
6. Intellectual Property
All content on this Website — including text, layout, design elements, and documents prepared by us — is owned by or licensed to Damai and is protected under Malaysian intellectual property law. You may print or download content for your personal, non-commercial use. You may not reproduce, distribute, or republish any content from this Website without our prior written permission.
7. Third-Party Links
This Website may contain links to external websites operated by third parties. Those links are provided for your convenience only. We do not endorse the content of any linked site and are not responsible for its accuracy, legality, or availability. Accessing a linked site is at your own risk.
8. Limitation of Liability
To the extent permitted by Malaysian law, Damai shall not be liable for any loss or damage — including indirect, consequential, or financial loss — arising from your use of or reliance on content published on this Website.
Our liability in connection with the provision of legal services is governed by the terms of your engagement letter and applicable law. Nothing in these Terms limits any liability that cannot be excluded by law, including liability for professional negligence.
9. Complaints
We take client concerns seriously and aim to address them promptly. If you are dissatisfied with our service, please write to us in the first instance at [email protected]. We will acknowledge your complaint within five working days and respond substantively within 21 days.
If your concern is not resolved to your satisfaction, you may refer the matter to the Malaysian Bar's Complaints Committee.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms or the use of the Website shall be subject to the exclusive jurisdiction of the courts of Malaysia.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be published on this page with a revised effective date. Your continued use of the Website following any update constitutes acceptance of the revised Terms.
